The Spanish judicial apparatus has completed its cycle, not in favour of justice but against the Basque patriotic left wing. Without going into deep legal details, in the end the Supreme Court gave the reason to the State and supported the processes that the Office of the public prosecutor asked for to make the Basque patriotic left wing illegal. The legal reasons that it alleged were shameful.
There was left the last option: the Spanish High Court. The lawyers of the persecuted candidacies presented their allegations to the Spanish judicial highest instance, although the social base of the Basque patriotic left wing knew beforehand the verdict: the judicial process has been and is a farce to justify a rabidly undemocratic apartheid. The previsions of those who have lost all their confidence in the Spanish justice, were fulfilled. The Constitutional Court backed the Spanish High Court had previously passed, the Spanish Government had already decided.
The scandalous process in which 380 candidacies have been made illegal under the pretext of being contaminated by people of the Basque patriotic left wing, has been an event of extreme gravity. This process has been known at an international level and it has caused very varied reactions. The antidemocratic Spain
The PSOE, promoter of the initiative, has congratulated itself because of the impeccable performance by the justice structures of Spain . "The State of right has worked. Justice has not suffered any coactions nor political impulse by the Spanish Executive. The strict fulfilment of the Law has been guaranteed and only those who do not adjust to the exigencies of the State of right have been left out of the democratic game". The PP, on its implacable crusade against the enemies of Spain, was not satisfied. It considers that the PSOE has made a transaction with ETA-Batasuna (Basque armed group and the Basque patriotic left wing). From PP's point of view, what from now on may happen is intolerable, since the Basque patriotic left wing returns to become part of the provincial and municipal institutions. The PP's intention consists in making an parliamentary interpellation, furthermore it has already promised that in the event that it may return to leader the government, it will remove the Basque patriotic left wing from the institutions, as it already did it before. United left (IU) has disappeared from the scene at the moment of the crime. This Spanish left wing party already made its task previously preparing the Spanish society for which it knew that it was going to happen. Throughout the previous process, IU has been an necessary collaborator for the PSOE in the strategy that the PSOE had designed before. IU defended PSOE and it transferred all the responsibility to those who would be the victims. This formation has largely contributed to socialize the vile concept of "contamination".
The antidemocratic Euskal Herria
The Basque Government does actively collaborate in the application of the Law of Political Parties. When the Public prosecutor requested information to the different police forces with presence in Euskal Herria in order to act against the candidacies of the Basque Patriotic left wing, was the most determined one in the fulfilment of this task. It gave all the data it had in order to make easier the work of the Spanish Public prosecutor; in the end, the Basque-Spanish police is some sort of judicial police. At the very same time the General Advisor of Justice of the Basque Government, in representation of all the Basque Government, made an institutional declaration against the Law of Political Parties, denouncing the legal crime that was being committed. This is clearly an example of hypocrisy. The PNV has made in Euskal Herria the same work that has made IU with at a state level. As the PNV knows the ample rejection that provokes the Law of Political Parties, it has done a spectacular exercise of cynicism and hypocrisy. The PNV did reject without much enthusiasm the Law of Political Parties but, at the same time, it justified the application of this unfair law making responsible of it to Batasuna. The PNV has diminished and ridiculed the efforts of this formation to claim for its rights; the PNV has considered Batasuna's vindications as mere "circus", "carnival", "racket".... In this way it has tried to turn the fight for the civil rights in just a mere mockery. Materialized the upsetting, the PNV has again ridiculed the protests of the Basque Patriotic Left Wing alleging that they use what happened to make the people believe that they are the real victims. EA, Aralar and other political groups located close to the leading-party (PNV) are not as obscene as the PNV but they also have given a disastrous image, since they have made not a even a little effort to denounce the inquisitorial plot. But, yes, they have regretted that the subject is "very boring" and that, as for Batasuna, that thanks to the ilegalización it is getting some sort of benefit.
The outcry of the persecuted and the marginalized ones
These ones, the outcry of the persecuted and the marginalized ones are who have assumed under their responsibility the defence of their supressed rights. They have been sent to the streets to socialize their claim.
The 3rd of May, while the Government prepared the election falsification, the Basque patriotic left wing celebrated concentrations of protest in front of the headquarters of the PSOE in Euskal Herria. The 5th of May, and while the High Court was in a meeting, different mobilizations in several of the Basque capitals were celebrated. The 6th of May, after being made public the resolutions of the Supreme Court, some representatives of the candidacies made illegal appeared in Donosti describing as a "trap" the performance by the PSOE and by the PNV as much during the process of negotiations, as during the pre-electoral process. The 7th of May, representatives of the Basque patriotic left wing considered that the situation that has been created after the ilegalización of 380 candidacies is very serious. On the other hand, ANV, the legal political party, since 130 of its candidacies have been made illegal, considers that these exceptional measures are a demonstration of "colonial justice" by Spain against Euskal Herria. ANV invited the citizenship to mobilize in Bilbao on the 12th of May.
From the very moment in which the resolution by the Spanish High Court was known, one of the Legal Teams of the Basque patriotic left wing worked against clock and presented a demand before the Constitutional Court. The demand, as it could be expected, had no influence on the decision by the State. On the 9th of May there were popular mobilizations in cities and towns. On the 11th the already illegal Basque patriotic left wing faced its election campaign from the street with generalized mobilizations. On the 12th , is ANV the political party the one calling for their supporters in Bilbo. On that evening, almost 20,000 people went to the streets and ask for the right to exert their civil and polìtical rights. When we say that "only the people save the people" we have in mind, with great satisfaction and recognition, those ones who feel to be part of the nation like ourselves: people who belong to other fields, but that they share our rage and our will of revolt. Without undergoing in ourselves the apartheid, they are raising its voice to denounce it along with us. Thank you very much to them all.
